Welcome to Flash Charge, an EV charging service operated by Automation Gallery Pvt Ltd (“Company”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our EV charging stations, mobile application, and website.

Please read these Terms carefully before using our services. These Terms constitute a legally binding agreement between you and Automation Gallery Pvt Ltd.

Acceptance of Terms

  • By accessing or using Flash Charge services, including our EV charging stations, mobile application, and website, you agree to be bound by these Terms of Service.
  • If you do not agree to these terms, you may not use our services.
  • We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.
  • These terms apply to all users of our services, including visitors, customers, and account holders.

Services and Payments

  • Flash Charge provides EV charging services at our network of stations across Kerala. Services are subject to availability.
  • All payments must be made through approved payment methods: UPI, credit/debit cards, net banking, or Flash Wallet.
  • Prices are displayed at stations and in the Flash App. We reserve the right to modify pricing with reasonable notice.
  • All transactions are final. Refunds are only issued in cases of service failure attributable to Flash Charge.
  • You are responsible for all charges incurred under your account, including unauthorized use you have failed to report promptly.

User Responsibilities

  • You must ensure your EV is compatible with the charging connector before initiating a session.
  • Do not leave your vehicle unattended for extended periods beyond the charging session duration.
  • Report any damaged or malfunctioning equipment to our support team immediately via the Flash App.
  • Do not attempt to tamper with, modify, or damage any charging equipment.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years of age to create an account and use our services.

Intellectual Property

  • All content on the Flash Charge platform — including logos, software, text, graphics, and data — is owned by Automation Gallery Pvt Ltd or its licensors.
  • You may not reproduce, distribute, or create derivative works from our content without explicit written permission.
  • The Flash Charge name, logo, and associated marks are registered trademarks of Automation Gallery Pvt Ltd.
  • Any feedback, suggestions, or ideas you submit to us may be used by us without compensation to you.

Prohibited Uses

  • Using our services for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempting to gain unauthorized access to our systems, servers, or networks.
  • Using our platform to transmit malware, viruses, or any other malicious code.
  • Engaging in any activity that disrupts or interferes with the proper functioning of our services.
  • Creating false or misleading information in your account profile.
  • Reselling or sublicensing our services without prior written authorization.

Limitation of Liability

  • Flash Charge services are provided on an 'as is' and 'as available' basis. We make no warranties regarding uninterrupted or error-free service.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
  • Our total liability for any claim arising from the use of our services shall not exceed the amount paid by you for the service in the preceding 30 days.
  • We are not responsible for any damage to your vehicle arising from the use of our charging stations, provided the equipment was in proper working condition.
  • Force majeure events including natural disasters, power outages, and government actions that affect service availability are excluded from our liability.

Governing Law & Dispute Resolution

  • These Terms of Service are governed by the laws of India, specifically the laws applicable in the State of Kerala.
  • Any disputes arising from these terms shall first be attempted to be resolved through good-faith negotiation.
  • If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
  • The courts of Kochi, Kerala shall have exclusive jurisdiction over any disputes that cannot be resolved through arbitration.
